What this value means
REDUCTION FROM 27.5% TO 25%, confirmed in the statute itself, not merely in commentary. COMMENCEMENT IS THE WEAK POINT AND MUST BE FLAGGED: section 1(2) of Act No. 20 of 2023 says 'This Act shall come into force on a date to be determined by the Minister by Notice in the Gazette' — the Act does not commence itself. The commencement notice could not be retrieved from any official host at confirmation. Tax practitioners and payroll vendors uniformly report the Act as effective 1 July 2024, i.e. from the year of assessment beginning 1 July 2024 and ending 30 June 2025, which is why effective_from is 2024-07-01; one large-firm summary instead describes the 25% rate as applying to year-ends after 31 December 2024. Treat the RATE as verified and the DATE as reported-but-not-gazette-verified. DRAFTING TRAP INSIDE THE ACT: the substituted Third Schedule opens 'For the purposes of Section 6(3) of the Order, the rates of tax to be levied for the year of assessment ending 30 June 2023 are as follows' — a year of assessment that had already closed before the Act was even assented on 14 July 2023. Do not read that sentence as the operative commencement; it is a drafting artefact carried over from the schedule being replaced. ERS'S OWN WEBSITE IS STALE ON THIS AND WILL MISLEAD A SCRAPER: the ERS 'Rates and Thresholds' page (https://www.ers.org.sz/IncomeTax/RatesandThres) still states 'The effective tax rate for companies (since the 1st July 2013) is 27.5% of taxable income' as at 24 July 2026. The statute overrides it. OTHER RATES IN THE SAME SCHEDULE (not this series): a trust, and a non-complying pension/provident/retirement-annuity/benefit fund, 33% of each Lilangeni; a resident natural person's dividend income 10% and taxable interest income 10%; a non-resident person other than a company or trust is subject to a floor of 10% of taxable income (3% on any pension component); a small business taxpayer as defined in the new Sixth Schedule pays turnover tax instead — 0% where gross turnover does not exceed E50,000 and 1.75% above that (presumptive tax, with the qualifying turnover threshold set at E500,000). Act No. 20 of 2023 also introduced transfer-pricing rules built on an arm's-length principle, an interest-deduction restriction, a 'beneficial tax regime' concept under a new section 65quin, and a new Seventh Schedule development-enterprise regime under which the Minister may confer tax concessions only with Cabinet approval and may revoke them for non-compliance. Withholding taxes on payments to non-residents are a flat 15% (dividends to SACU-area shareholders, interest outside SACU, royalties and management fees, non-resident contractors, entertainers, repatriated branch profits) and resident withholding is 10% on interest, dividends and rental payments by an agent, 33% on payments to trust beneficiaries. ACCESS: the ERS legislation PDF above is a 38-page IMAGE-ONLY SCAN with no text layer — it must be rendered page by page and read visually; text extraction returns 37 characters for the whole document. All ers.org.sz hosts serve an incomplete TLS chain ('unable to verify the first certificate'), and legislation is served from port 8000. EswatiniLII returns HTTP 403 behind Cloudflare. No consolidated Income Tax Order incorporating Act 20 of 2023 is published anywhere — the ERS-hosted Income Tax Order 1975 PDF is the unamended principal Order.
