REFUSAL — court discretion throughout: s 26(1) of the Civil Procedure Act lets the court order pre-decree and post-decree interest at such rate as it deems reasonable, and no late-payment-of-commercial-debts statute exists. The only fixed, citable figure is the s 26(2) FALLBACK: where a money decree is silent on post-decree interest, 6% per annum is deemed — a gap-filler for decrees, not a creditor-facing rate. The widely cited 12%/14% 'court rates' come from a 1982 practice direction and case law, not any gazetted instrument, and are not citable as statutory rates. CITATION TRAPS: the interest provision is in the Civil Procedure Act (Cap 21), NOT the Judicature Act (which ends at s 11); on new.kenyalaw.org the Act lives at /akn/ke/act/1924/3 — the /akn/ke/act/cap/21 path 404s.
