WHAT A PAYROLL ENGINE GETS WRONG IN BURKINA FASO. 1. THE HEADLINE TOTAL DID NOT MOVE, BUT EVERY BRANCH DID. Decret n°2023-0129 of 24 February 2023 kept the global taux d'appel at 21,5% (16% employer, 5,5% worker) and kept the employee deduction at 5,5%, while reallocating the employer's 16% between the branches: family benefits 7% to 6%, occupational risks 3,5% to 1,5%, employer old-age 5,5% to 8,5%. A stale table therefore produces the CORRECT total payroll cost and the CORRECT net pay, and only goes wrong on the per-branch declaration and on any branch-level reporting or accrual. This is the single most likely undetected error in a Burkinabe payroll: it does not show up in a reconciliation of totals. 2. THE CEILING IS 800 000 FCFA A MONTH, NOT 600 000. Arrete n°2022-067 of 30 August 2022 raised it from 600 000 (set in 2003) and expressly abrogates the 2003 arrete. It takes effect from its date of signature, not from the start of a month or a year. Widely circulated summaries, including several that otherwise track the 2021 law, still carry 600 000. 3. THE CEILING IS EXPRESSED ANNUALLY AS WELL AS MONTHLY, AND THE TWO ARE STATED AS EQUIVALENT. Article 2 fixes 9 600 000 FCFA per insured per year "soit" 800 000 per insured per month. It is a cap, not an exemption: above 800 000 the employee stays insured and contributions are simply computed on 800 000, giving a flat maximum of 44 000 FCFA employee and 128 000 FCFA employer per month. 4. OCCUPATIONAL RISK IS A SINGLE NATIONAL RATE HERE. Unlike almost every other CIPRES member in the region, Burkina Faso does not grade the occupational-risk rate by activity class - arrete n°2023-018 says so expressly. What it does have is a compliance-based doubling of the rate against an individual employer, imposed only after inspection and a report that operates as a mise en demeure. Model it as an employer-level flag, not an industry lookup. 5. ONLY ONE BRANCH TOUCHES THE PAYSLIP. Family benefits and occupational risks are wholly employer-borne. The employee's deduction is 5,5% for old-age and nothing else. There is no employee health contribution in this scheme. 6. CIPRES DOES NOT SET THE RATE. Burkina Faso is a member of the Conference interafricaine de la prevoyance sociale, and CNSS board deliberations expressly include the reports of the CIPRES Regional Inspection - but CIPRES harmonises supervision and prudential standards, not contribution rates. Each member state fixes its own by national instrument, and the plafonds differ sharply across the region. Do not carry a Burkinabe rate or ceiling across to another WAEMU state. 7. THE OPERATIVE LAW IS THE 2021 LAW, NOT THE 2006 LAW. Loi n°004-2021/AN of 6 April 2021 replaced loi n°015-2006/AN of 11 May 2006. Instruments still in force under the new law cite the 2021 law's articles (article 10 for the plafond, article 12 alinea 3 for the occupational-risk rate), so a citation to loi 015-2006 is a reliable marker that a source predates the current position. WHAT WE DO NOT PUT A NUMBER ON: I put no number on the following, deliberately. HEALTH INSURANCE. Burkina Faso legislated a universal health insurance scheme (assurance maladie universelle) but it is not a CNSS branch and no employer/employee payroll contribution rate is called for private-sector salaried workers under the regime described here. Creating a nulled branch would wrongly imply a live payroll obligation. If and when a health contribution is called, it will arrive as its own instrument. THE DOUBLED OCCUPATIONAL-RISK RATE. Arrete n°2023-018 sets a ceiling on the penalty ("jusqu'a concurrence du double", so a maximum of 3%) but does not fix a scale between 1,5% and 3%. The applied figure for a sanctioned employer comes from the CNSS's notification, not from a published table. TAX DEDUCTIBILITY OF THE EMPLOYEE SHARE. I did not reach the Code general des impots provision governing whether the 5,5% worker contribution is deductible from the IUTS base, so the tax_deductible flag is omitted rather than guessed. SOURCING CAVEATS: The plafond arrete (n°2022-067) and the occupational-risk arrete (n°2023-018) were read in full from the CNSS's own published scans and are quoted from the operative articles. The per-branch rates come from the CNSS's own current cotisations page, which names decret n°2023-0129 of 24 February 2023 as their source; the CNSS's documentation page carries a link labelled for that decret but it serves a different document (decret n°2007-413 portant statut general des etablissements publics de prevoyance sociale), so the decret's own text and its stated entry-into-force date remain unread. The rates are corroborated internally by the CNSS's own voluntary-insured figure of 14%, which equals the combined old-age branch rate. effective_from is set to the date of the decret. Re-verify at the next annual CNSS publication and after any Conseil des ministres session amending the taux d'appel, which is the instrument that moves - the plafond arrete and the law move far less often.
