ONE RATE FOR EVERYTHING: art. 2 of loi n°2021-20 fixes the rate 'en toute matière' — there is no civil/commercial split and no separate consumer rate. It is the moratory-damages rate a late-paying debtor owes where the parties fixed no other rate by contract (art. 1); a contractual rate displaces it. POST-JUDGMENT UPLIFT — THE BIGGEST TRAP: under art. 3, where a debtor is ordered to pay legal interest, the rate is 'majoré de moitié à l'expiration d'un délai de deux (2) mois à compter du jour où la décision de justice est devenue exécutoire, fût-ce par provision' — increased by half, i.e. 8.0456% for 2026, running from two months after the judgment becomes enforceable (including provisional enforcement). The enforcement judge may, on either party's application and in light of the debtor's situation, waive or reduce that uplift. SET NATIONALLY, COMPUTED UNION-WIDE: the Minister of Finance issues the arrêté and publishes the rate in the Journal officiel, but the art. 2 formula is the duration-weighted average of the BCEAO's maximum refinancing rates over the PRIOR calendar year — union-wide inputs, so all eight UMOA states carry the identical figure (2026: 5.3637%; 2025: 5.50%). Loi n°2021-20 transposes the UMOA uniform law (Décision n°CM/UMOA/010/06/2013 of 28 June 2013) and repealed arts. 11 and 12 of loi n°81-25 of 25 June 1981. THREE TRAPS: (1) Do not confuse this with the TAUX D'USURE — a different instrument, governed by the separate loi n°2021-19 of 21 January 2021 and set at union level (14% for banks, 24% for finance companies and SFDs from 1 June 2026, Décision n°19/29-12-2025/CM/UMOA). (2) The rate is published to four decimals and must not be rounded — it is 5.3637%, not 5.36% or 5.4%. (3) The rate governs from 1 January but the arrêté is signed weeks later (19 February 2026), so early in a year the national instrument may not yet exist even though the year's rate does. NEXT FIXING: the 2027 rate, expected by ministerial arrêté in Q1 2027 and consolidated in the BCEAO's annual UMOA table.
