What this value means
REFUSAL — the entitlement exists but the number does not. A Congolese creditor has a clear right to interest on a late-paid commercial debt under the OHADA Acte uniforme, which measures it 'au taux d'intérêt légal, applicable en matière commerciale' and runs it from the mise en demeure — but OHADA does not fix that rate, and no Congolese instrument does either. No rate-fixing law, décret or arrêté appears in the Journal officiel de la République du Congo, and the Congolese civil law of obligations — inherited from the French Code civil — measures moratory damages on a money debt by the interest 'fixé par la loi', which points to a rate-fixing statute Congo has not enacted. WHAT EXISTS, AND WHY NONE OF IT IS THE ANSWER: CEMAC's Règlement n°04/19/CEMAC/UMAC/CM of 10 August 2020 governs the taux effectif global, the repression of usury and the publication of bank conditions — a CEILING on lending rates, not a default rate owed by a late payer. The BEAC, unlike the BCEAO (which publishes an annual taux d'intérêt légal table for the eight UMOA states), publishes no legal interest rate for the six CEMAC states; its TIAO is a monetary policy rate, 4.50% since 29 June 2026 (Décision N°01/CPM/2026). THE TIAO TRAP: practitioners across the BEAC zone commonly argue the TIAO as the legal interest rate. That is a convention and a litigating position, not an enacted Congolese rate — serving it would state as law what is only an argument. CAMEROON IS THE EXCEPTION, NOT THE RULE: it alone in CEMAC has legislated an express peg (loi n°2004/015 of 21 April 2004, capping the rate at the TIAO for the enforcement of judgments) — that statute has no application in Congo. In practice a Congolese creditor pleads a contractual rate or asks the court to fix the interest.
