The statutory rate is defined by reference to the BEAC TIAO, which we hold as the CM policy-rate series; the number is computed from that series rather than read from a Cameroonian instrument, because art. 2(2)'s joint ministerial publication is not issued on each BEAC move.

What this value means

Cameroon's taux d'intérêt légal is pegged to the BEAC tender rate (TIAO), currently 4.50% since 29 June 2026 (Décision N°01/CPM/2026, down from 4.75%). It moves the day the BEAC Monetary Policy Committee moves the TIAO — there is no annual fixing. SCOPE IS NARROW, AND THIS IS THE MAIN TRAP: loi n°2004/015 fixes the rate 'en matière d'exécution des décisions de justice' — it is post-judgment interest, not a general late-payment rate attaching to an unpaid invoice. Under art. 2(3), 'L'intérêt court à compter de la signification-commandement de la décision exécutoire' — interest runs from service of the enforcement demand on the enforceable judgment, not from the invoice due date or the mise en demeure. SECOND TRAP — 'AU PLUS': art. 2(1) sets the TIAO as a CEILING ('est, au plus, le taux d'intérêt des appels d'offres'), not a fixed equality, so a court may award less; 4.50% is the maximum a creditor can obtain, not a guaranteed entitlement. THIRD TRAP: art. 2(2) requires the rate to be 'publié périodiquement par un texte conjoint des Ministres chargés de la justice et des finances' — that joint ministerial publication is not reliably issued after each BEAC move, so the operative published figure can lag the TIAO; where an exact figure must be pleaded, check for a current texte conjoint rather than assuming the live TIAO. RELATED BUT DIFFERENT NUMBERS: art. 3 caps the CONVENTIONAL rate at the monetary authority's rate 'majoré d'un point' (TIAO + 1pp = 5.50%); Cameroon's public-procurement code applies late-payment interest to public contracts at the TIAO plus one point. Commercial sale-price claims reach this rate through OHADA: the Acte uniforme relatif au droit commercial général entitles an unpaid party to interest 'calculés au taux d'intérêt légal, applicable en matière commerciale', running 'de l'envoi de la mise en demeure adressée à l'autre partie par lettre recommandée avec accusé de réception, ou par tout autre moyen écrit' — art. 263 of the original 1997 Act, renumbered by the revised Act adopted at Lomé on 15 December 2010 and commonly cited as art. 291, so check which numbering a source is using. Loi n°2004/015 repealed loi n°90/028 du 10 août 1990. Derived live from this API's CM policy-rate series (the BEAC TIAO).
