Equatorial Guinea Statutory interest (interés legal / taux d'intérêt légal)
Equatorial Guinea Statutory interest (interés legal / taux d'intérêt légal): no single figure applies. The reason is set out below, cited to the governing instrument. Last checked against the official source on 10 Aug 2026.
Equatorial Guinea publishes no legal interest rate. OHADA commercial law entitles an unpaid creditor to interest 'au taux d'intérêt légal' but leaves the figure to national law, and no Equatoguinean instrument fixes one.

What this value means
REFUSAL — the entitlement exists but the number does not. Equatorial Guinea is an OHADA member and its commercial creditors have the Acte uniforme right to interest on a late-paid price, measured 'au taux d'intérêt légal, applicable en matière commerciale' and running from the mise en demeure — but OHADA does not fix that rate and no Equatoguinean instrument does. THE HISPANOPHONE COMPLICATION: unlike the other five CEMAC states, Equatorial Guinea's private law derives from the Spanish Código Civil rather than the French Code civil. Under that tradition a money debtor in mora owes, absent agreement, 'el interés legal' — but the figure is supplied by separate legislation, which in Spain is the annual Ley de Presupuestos Generales del Estado. Equatorial Guinea enacts no equivalent annual fixing, so the code's reference resolves to nothing. Do not import Spain's current interés legal del dinero: it is a Spanish budget-law figure with no application in Malabo. WHAT EXISTS, AND WHY NONE OF IT IS THE ANSWER: CEMAC's Règlement n°04/19/CEMAC/UMAC/CM of 10 August 2020 governs the taux effectif global, the repression of usury and the publication of bank conditions — a CEILING on lending rates, not a default rate owed by a late payer. The BEAC, unlike the BCEAO (which publishes an annual taux d'intérêt légal table for the eight UMOA states), publishes no legal interest rate for the six CEMAC states; its TIAO is a monetary policy rate, 4.50% since 29 June 2026 (Décision N°01/CPM/2026). CAMEROON IS THE EXCEPTION, NOT THE RULE: it alone in CEMAC has legislated an express peg (loi n°2004/015 of 21 April 2004) — that statute has no application in Equatorial Guinea. In practice a creditor pleads a contractual rate or asks the court to fix the interest.
