What this value means

Togo is NOT a matrix jurisdiction: there is one single national floor. The arrete fixes the SMIG and the SMAG (Salaire Minimum Agricole Garanti - agricultural minimum) at the SAME level, 302.89 XOF/hour = 52,500 XOF/month, 'sur toute l'etendue du territoire national et pour toutes les branches d'activite economique', effective 1 January 2023. Re-confirmed on the government's own channels (Gouvernement Togolais statement of 1 January 2023: 'le SMIG et le SMAG sont desormais fixes a 302,89 FCFA/heure soit 52.500 FCFA/mois sur toute l'etendue du territoire national'; republiquetogolaise.tg 'SMIG et SMAG : le gouvernement acte les nouveaux montants'; savoirnews, 2 January 2023). BEWARE a widely-copied aggregator error: several commercial HR/salary sites (lqdd.org, africarrieres.com) publish a separate SMAG of 38,500 XOF/month. We could find no instrument supporting that figure and the official 2023 announcements contradict it - do not serve 38,500 and do not treat it as a lower general floor. Arithmetic check on the official pair: 302.89 XOF/h x 40h/week x 52/12 = 52,500 XOF/month, internally consistent on the statutory 40-hour week; the same check passes on the 2012 predecessor (201.92 x 173.33 = 35,000). The monthly figure is the legally quoted headline; the hourly rate is operative for part-time and hourly work. Legal basis chain: Loi n°2021-012 du 18 juin 2021 portant Code du travail leaves the SMIG to be fixed by regulation after consultation with the social partners; the 31 December 2022 arrete was made following a 30 December 2022 tripartite agreement between government, employer organisations and the trade union centrals. This was a 50% uplift and the first revision in over ten years. VERIFICATION CAVEAT, stated plainly: the 52,500 figure and the arrete number 3790/MFPTDS/DGT are confirmed by the Ministry of Finance's own site and by the government's official portal, but we could NOT load the arrete's own text or its Journal Officiel publication from a government host - jo.gouv.tg does not surface a searchable 2022/2023 index, republiquetogolaise.tg returns HTTP 403 to automated fetches and republiquetogolaise.com returns HTTP 404 on the archived slug. A third-party scan titled 'Arrete N°3790 - Revision du SMIG et du SMAG - 31.12.2022' circulates on Scribd; we did not treat that as primary. The predecessor instrument (see history) WAS loaded in full from ILO NATLEX and is quoted there. As at 2026-07-20 the rate is unchanged: no revision occurred in 2024, 2025 or 2026, and the union federations (CNTT, CSTT, UNSIT) are publicly demanding at least 60,000 XOF without government agreement - treat any 2026 uplift as pending, not enacted.
